Privacy Policy | The Profit System

This Privacy Policy explains how The Profit System LLC (“The Profit System”, “we”, “us”) collects, uses and protects personal information when you visit www.theprofitsystem.com or use The Profit System CRM (together, the “Service”). It works together with our Terms of Service.

1. Two kinds of data

Your information: what we learn about you as a visitor or a customer (for example your name, email and plan). We decide how this is used, as explained below.
Customer Data: what you and your team put into your CRM about your own contacts (contacts, conversations, deals, bookings, notes and payments). You own and control it. We only process it on your behalf, to run the Service for you.

2. What we collect

Forms on our site: when you send us a question or ask for a demo, we receive what you type: name, email, phone (optional), your message, business type, team size, the plan you are looking at and the page you sent it from. If you tick a consent box, we record what you agreed to and where.
Checkout and account: plans are bought through Whop. Whop processes your payment under its own privacy policy; we never see or store your full card number. We receive your name, email, Whop username, your business name, your plan and its status, so we can create your CRM, give you access and support you.
Using the CRM: we keep a log of activity in your account (who changed what, and when) so you can see it and undo mistakes, and so we can keep the Service secure.
Technical data: like any website, our hosting provider receives your IP address, browser type and the pages you request, which we use to run and protect the Service. Our pages load fonts from Google Fonts, so Google also receives your IP address when a page loads.

3. Cookies

We do not use advertising or tracking cookies, and we do not run ad pixels on our site. The CRM uses essential cookies to keep you logged in. Our checkout page loads Whop’s secure checkout, which may set its own cookies under Whop’s privacy policy. You can block cookies in your browser, but logging in and checkout may then not work.

4. How we use your information

to provide the Service, create your CRM and give you access;
to manage your plan, trial and billing with Whop;
to answer your questions and give you support;
to send you service messages, such as account, security and billing notices;
to keep the Service secure and to find and fix problems;
to send you news about The Profit System, only if you asked for it, and you can unsubscribe at any time;
to meet legal obligations and enforce our Terms.

5. Customer Data

We process Customer Data only to provide the Service to you, on your instructions. We do not sell it, we do not use it for advertising, and we do not contact your contacts ourselves. If one of your contacts asks us about their data, we will pass the request to you. A data processing agreement (DPA) is available on request at support@theprofitsystem.com.

6. Who we share it with

We do not sell or rent personal information, and we do not share it for advertising. We share it only:

with the subprocessors listed below, so they can run parts of the Service for us;
when the law requires it, for example a valid court order, or to protect the rights and safety of our customers, the public or us;
with a buyer or successor if our business is sold or merged, under the same protections as this policy.

7. Subprocessors

Cloudflare: hosting, the database and file storage for the site and the CRM.
Whop: checkout, billing, receipts and the login to your account.
Amazon Web Services (Amazon SES): sending email from the CRM, when email sending is switched on for your account.
Twilio: sending and receiving text messages (SMS), which are coming soon, once SMS is switched on for your account.

8. How long we keep it

Customer Data: while your plan is active, and for 30 days after it ends, so you can come back or ask for an export. After that we delete it.
Account and billing records: for as long as your account is open, then as long as tax and accounting law requires.
Messages and form requests to us: as long as needed to answer you and keep a record of the conversation.

9. Security

The Service runs on Cloudflare. Data is sent over encrypted connections (HTTPS), access to it is limited to people who need it to run and support the Service, and changes in your account are logged. No system can be guaranteed 100% secure. If a breach affects your personal information, we will tell you as the law requires.

10. Your choices and rights

You can ask us to show, correct, export or delete the personal information we hold about you, and you can opt out of news emails at any time. Customers can export their Customer Data from Settings whenever they want. Depending on where you live (for example California, under the CCPA, or the EU and UK, under the GDPR), you may have further rights, such as to object to or limit some uses. Write to support@theprofitsystem.com; we will reply within the time the law requires and will not treat you differently for asking.

11. Where data is processed

We are based in the United States. Our subprocessors may process data in the United States and other countries where they operate, with safeguards that the law requires.

12. Children

The Service is for businesses and adults. It is not meant for anyone under 18, and we do not knowingly collect personal information from children.

13. Changes to this policy

We may update this policy. We will change the date at the top, and if a change is significant we will tell customers by email or in the Service before it takes effect.
